Tax reform 2021 was sued because some congressmen did not have time to read it

With the argument that the recent approval of the 2021 tax reform in the Congress of the Republic has formal and procedural defects, the representative to the Chamber Germán Navas Talero, of the Democratic Pole, filed a claim of unconstitutionality, before the Constitutional Court.

In the opinion of Navas Talero, in the approval process of Law 2155 or Law of Social Investment “the principle of publicity was violated, since the publication of the papers was given just a few hours before the plenary session was summoned to the approval of that project ”.

According to the parliamentarian, “it cannot be expected that the members of the plenary had reasonably and rationally read the three presentations between 7:30 pm on September 6 and 9 am the following day and had formed a criterion to intervene in the debate".

According to the congressman, “if the texts had been read, at that time it was impossible to guarantee the formal study of the papers, which ended up undermining the debate on the initiative, to such an extent that what was really intended to be done was to prevent it.

"The foregoing clearly shows that the opposition was not wanted to have a real knowledge of the presentations to be able to exercise the right to discuss and dispute their content," he said.



Within the lawsuit, the request for postponement made by the representative Mauricio Toro Orjuela was also taken into account, who precisely asked for more time to be able to make a judicious reading and study of the presentations, to which the majority decided not to accept.

The Constitutional Court will be the body that decides the fate of what would be the Duque government's last chance to present a tax reform.
